Obtaining Information Under EIR

ACCESS TO CON29R (2007) (Enquiries of Local Authority) INFORMATION FOR PERSONAL SEARCH AGENTS AND MEMBERS OF THE PUBLIC

The Local Authorities (England)(Charges for Property Searches) Regulations 2008

Environmental Information Regulations 2004

Information in respect of the CON29R is available to members of the public (including personal search agents) through the Local Land Charges team in accordance with the Local Authorities (England)(Charges for Property Searches) Regulations 2008 and the “Personal Search Guidance Note” published by this council.  Should you choose to use this facility, then our published process (including charges) will apply.

Further to the guidance published by the Information Commissioner’s Office dated 16 July 2009, Guidance issued by the Local Government Association on 16 July and the Communities & Local Government Statement issued 22 July 2009, if you wish to apply for access to property related information under the Environmental Information Regulations 2004 (EIR), then please contact the relevant data-owning department direct (not the Local Land Charges team).  It is the enquirer’s responsibility to ascertain from each data-owning department whether or not a fee is payable for access in accordance with the regulations.  Departments will provide access to the information in accordance with the EIR as soon as possible, and no later than 20 working days following receipt of the request.

Customers (including personal search agents) obtaining information through EIR should in each case also confirm with individual data-owning departments whether the provisions of the Re-use of Public Sector Information Regulations 2005 apply.
